Let me give it a shot:

Quote:
will my oldest son have to go somewhere to register? Meaning: do they have to know that he lives/works there?

No. If he has a passport, he is a citizen, and as such is free to go. He'll be greeted at the border with "Welcome Home".

Quote:
will he be able to open an American bankaccount without any problems?

Yes. You don't even need citizenship or a SSN for that. I got one while I was visiting the US as a tourist. The only hurdle may be his credit worthiness if he has a short or no credit history. However, this can be overcome, depending on the financial institution.

Quote:
how is it with dental and medical insurance?

He will have to find employment that offers these benefits as part of his compensation. He can buy private insurance, but it is very expensive.

Quote:
will he need a green card or anything else?

Nope, again he is a citizen.

Quote:
when we move there will any one of us need a green card or visa?

This is where I need to ask you a question. You say you have a SSN, but no passport or green card. What is/was your legal status when you lived in NM? A lot of your question will depend on the legal status you had.

Quote:
if you still have debts here will one be able to leave the country? Does someone have experience with that?

You can leave, any day. No debt in any country will legally bar anyone from leaving that country. That said, he should contact his creditors to arrange for a payment plan of some sort, and let them know his new address in the USA after he moves. He should by no means simply abandon his debts.
_________________
SC Firefighter

Subject: Strange situation
Posted: Mon 05 12,08 9:06 am (GMT -6)

Hello everyone,

Trying to obtain as much info as I can, I stumbled upon this forum. Í searched, but cannot seem to find our particular situation anywhere. So, let me post it and lets see who can help us out:

My name is Annabelle. I was an AF wife for 13 years, lived in New Mexico for 6 years. We have 3 children together. After our divorce I went back to the Netherlands with 2 of our 3 children, our daughter stayed with her dad the 2 boys went with me. Contact between the boys and their dad is minimal anymore, unfortunately contact between me and my daughter is minimal as well (not my choice).
Anyway: oldest son wants to move to the States. He is 21 years of age, has dual citizinship (as do the other 2 as well), has an American passport and a SSN (as does the youngest one as well). He's gonna move around august of this year. He will move to Albuquerque to live with a cousin of mine. He will work for her boyfriend.
I remarried and me and my husband want to make the move as well, we want to move Summer 2009, after the youngest graduated High School.
I have a SSN as well, no American passport and no green card.

Questions:
- will my oldest son have to go somewhere to register? Meaning: do they have to know that he lives/works there?
- will he be able to open an American bankaccount without any problems?
- how is it with dental and medical insurance?
- will he need a green card or anything else?
- when we move there will any one of us need a green card or visa?
- if you still have debts here will one be able to leave the country? Does someone have experience with that?

All info is helpfull and greatly appreciated!
Subject: re: Dissability question
Posted: Sat 05 10,08 7:57 pm (GMT -6)

There is an agreement on file with the SSA and the Dutch equivalent that allows for your Dutch work life to be counted towards your US eligibility for benefits. However, I don't believe it is easy to have done, and I certainly have not read about anyone who did it.

I've done some quick searching, and I believe the following "Totalization Agreement" is what I was referring to:
http://www.ssa.gov/international/Agreement_Pamphlets/netherld.html

Quote:
An agreement effective November 1, 1990, between the United States and the Netherlands improves Social Security protection for people who work or have worked in both countries. It helps many people who, without the agreement, would not be eligible for monthly retirement, disability or survivors benefits under the Social Security system of one or both countries.
and

Quote:
If you do not wish to file a claim for benefits, but would like more information about the agreement, write to:

Social Security Administration
Office of International Programs
P.O. Box 17741
Baltimore, Maryland 21235-7741
U.S.A.

Here is the text of said agreement: http://www.ssa.gov/international/Agreement_Texts/nthrlnds.html , and in particular:

Quote:
PART III
Provisions on Benefits

Chapter A
Provisions Applicable to the United States

Article 15

1. Where a person has completed at least six quarters of coverage under United States laws, but does not have sufficient quarters of coverage to satisfy the requirements for entitlement to benefits under United States laws, the agency of the United States shall take into account, for the purpose of establishing entitlement to benefits under this Article, periods of coverage which are credited under the laws of the Netherlands and which do not coincide with periods of coverage already credited under United States laws.

It specifically says "shall", not "may" or "should", but "shall". I love researching this stuff.
So, in short, your short time in the US will not keep you from benefits, but that doesn't mean that you would otherwise qualify.

Good luck
_________________
SC Firefighter

Eileen,

Thank you for your response I really appreciate it!. I know all about paying into the system and not qualifying right now anyways . I thought that I had read somewhere that you could take the social security that has build up in the Netherlands with you??? I read that somewhere and was hoping someone actually new more about that.

I can ask my boss about the family leave he will have no problem I am, self employed so that is going to be difficult.

Once again thank you, I know that there is little to no solution but I'm trying!

Hi Belinda,
First of all, I am sorry to hear of your diagnosis and I hope in the next months that your treatment brings you improved health and a happier outlook (cancer in remission).
Now about your question, .....I am not sure where you get your information that overwhelming cancer treatment allows an American citizen a disability. I have 4 friends/relatives undergoing cancer treatment (one diagnosed stage 4) and they all go to work or lose their health care coverage and don't get paid a salary. My stage 4 friend, had two months off work because her co-workers donated their vacation time to her to use(her company allowed that). She now goes to work everyday and I don't need to tell you how difficult that is. You already know.
Disability in America is under the Social Security system. To qualify for social security (and thus disability) you must pay into the system for 40 quarters. That is 4 quarters a year for 10 years if you work full time. So, even though you are not an American citizen, you still do not qualify for a disability payment since you have not paid into the system for 40 quarters.
Of course you can always check the Social Security website for their regulations regarding filing for disability. Maybe they have better news than I have found with my friends and family.
Have you talked to your employer about reduced hours or the FMLA(family medical leave act), I think you can use that for yourself. You might have to pay your own health care coverage during use of the FMLA. Maybe you can work from home part-time and not have the stress of commuting or dressing up everyday. Talk to your human resources (if you trust them) and see what they can offer to help relieve the pressure of your job so you can focus on getting well.
Best of luck and you are in my prayers.
-e
Hi,

I was diagnosed with stage 3 cancer. I know that I would be allowed to get dissability if I was a US citizen but I am not, I am still having my Dutch nationality with my green card.

Its not that I am hell bend on getting dissability but with going through treatments its hard to work but I do need my income, does anyone here has experience with this situation???

I would be nice to know that I would qualify for something and get the stress of keeping my job eliminated if I do not feel well and not being able to work because of my treatments.

Thank you so much in advance!!

Subject: re: Vraagje over Credit Reports
Posted: Thu 05 01,08 9:50 pm (GMT -6)

_________________
Benno Groeneveld
